1. Introduction and Acceptance of Terms
Welcome to Rupkatha (the "Website"), operated by Rupkatha Boutique, a retail and e-commerce business registered at Bimal Sinha Sarani, Ward 12, Hakim Para, Siliguri, West Bengal 734001 ("we," "us," "our," or the "Company"). these Terms, please discontinue use of our Platform immediately.
These Terms constitute a legally binding agreement between you and the Company under the laws of India,
including but not limited to the Information Technology Act, 2000; the Consumer Protection Act, 2019; the
Consumer Protection (E-Commerce) Rules, 2020; and other applicable laws of the State of West Bengal.
2. Eligibility
To access and use our Platform and make purchases, you must meet the following eligibility criteria:

• You must be legally capable of entering into a binding contract under the Indian Contract Act, 1872.

Rupkatha offers the following categories of products through our Platform:

georgette, chiffon, and blended fabric sarees.
• Home Decor Items – Decorative accessories and furnishings for home interiors.
• Suit Pieces for Females – Dress materials, salwar suit sets, and ethnic fabric pieces.
We make every effort to display product descriptions, images, colours, and specifications as accurately as
possible. However, we do not guarantee that the actual product will match the digital representation exactly,
as colours and textures may vary due to screen settings, lighting conditions, and fabric characteristics.
4.2 Product Availability
All products are subject to availability. We reserve the right to discontinue any product at any time without prior
notice. In the event that a product you have ordered becomes unavailable after your order is confirmed, we
will notify you and offer a suitable alternative, store credit, or a full refund.
4.3 Pricing
All prices are listed in Indian Rupees (INR) and are inclusive of applicable Goods and Services Tax (GST)
unless expressly stated otherwise. Prices are subject to change without notice. The price applicable to your
order will be the price displayed at the time of order confirmation.
5. Order Placement and Purchase Process
5.1 Order Confirmation
Your order is confirmed only upon receipt of a written confirmation from us via email or SMS. An order placed
on the Platform does not constitute a binding contract until such confirmation is issued by us.
5.2 Right to Cancel or Refuse Orders
We reserve the right to accept, reject, or cancel any order at our discretion without assigning any reason.
Such situations may include but are not limited to:
• Inaccurate product information or pricing errors.
• Non-availability of stock.
• Suspected fraudulent or unauthorized transactions.
• Failure to meet eligibility requirements.
In the event of cancellation after payment, a full refund will be initiated within 7-10 business days through the
original payment method.
5.3 Order Modification
Once an order has been placed, modifications may not be possible. Please contact us at

to accommodate modifications before the order is dispatched.
6. Payment Terms
We accept the following payment methods on our Platform:
• Credit Cards and Debit Cards (Visa, MasterCard, RuPay, American Express, and other supported
networks)
• UPI (Unified Payments Interface) – including Google Pay, PhonePe, BHIM UPI, Paytm, and other
UPI-enabled apps
• Cash on Delivery (COD) – available for eligible orders within serviceable areas
All online transactions are processed through secure, third-party payment gateways. We do not store your
complete card details on our servers. By making a payment, you represent and warrant that the payment
information you provide is truthful, accurate, and that you are authorized to use the selected payment method.
For Cash on Delivery orders, payment must be made in full to our delivery partner at the time of delivery.
Failure to make payment upon delivery may result in the suspension of your ability to place future COD orders.

7. Shipping and Delivery

We are committed to delivering your order within the timeframe specified at the time of purchase. Delivery
times are estimated and may vary due to factors beyond our control, including logistics partner delays, natural
events, or public holidays. We do not accept liability for delays caused by such circumstances.
8. Returns, Refunds, and Cancellations

("Content"), is the exclusive property of Rupkatha Boutique or its content suppliers and is protected under
applicable Indian and international intellectual property laws.
You are granted a limited, non-exclusive, non-transferable, revocable license to access and use the Platform
solely for personal, non-commercial shopping purposes. You may not:
• Reproduce, duplicate, copy, sell, resell, or exploit any portion of the Platform or Content for
commercial purposes without express written permission from us.
• Modify, create derivative works from, or reverse-engineer any part of the Platform.
• Use any data mining, robots, scrapers, or similar data-gathering tools.

Boutique disclaims all warranties including but not limited to:

• Warranties that the Platform will be uninterrupted, error-free, or free of viruses or other harmful
components.
• Warranties regarding the accuracy, completeness, or reliability of any content on the Platform.
12. Limitation of Liability

14. Governing Law and Dispute Resolution
14.1 Governing Law
These Terms shall be governed by and construed in accordance with the laws of India. Any disputes arising
out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the competent courts
located in Siliguri, District Darjeeling, West Bengal, India.
14.2 Dispute Resolution
In the event of any dispute, controversy, or claim arising out of or relating to these Terms, we encourage you
to first contact us at rupasaha339@gmail.com to resolve the matter amicably. If a resolution cannot be reached
within 30 days, the dispute shall be referred to arbitration in accordance with the Arbitration and Conciliation
Act, 1996 (as amended). The seat of arbitration shall be Siliguri, West Bengal.
14.3 Consumer Rights
Nothing in these Terms limits your rights as a consumer under the Consumer Protection Act, 2019, or any
other applicable consumer protection legislation in India. You may also approach the appropriate consumer
forum or the National Consumer Helpline (NCH) for redressal.

remaining provisions shall continue in full force and effect.
19. Entire Agreement
These Terms, together with our Privacy Policy, Shipping Policy, and Return & Refund Policy, constitute the
entire agreement between you and the Company regarding your use of the Platform and supersede all prior
and contemporaneous understandings, agreements, representations, and warranties.
